This week, the U.S. Department of State posted a proposed rule that would amend the International Traffic in Arms Regulations to revise Categories I (firearms, close assault weapons and combat shotguns), II (guns and armament) and III (ammunition and ordnance) of the U.S. Munitions List (USML) to describe more precisely the articles warranting export and temporary import control on the USML. The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) posted a companion proposed rule to amend the Export Administration Regulations (EAR) to describe how the items that transfer to the EAR will be controlled. Interested parties may submit comments on the proposed rules within 45 days of the date of publication in the Federal Register. As of yet, the proposed rules have not been published in the Federal Register. The proposed rules will be published in the Federal Register on May 24, 2018.
